Terms of Service

1. Who we are
GoCapturit (“GoCapturit”, “we”, “us”) is a sole proprietorship operated by Valentine Huy in Ontario, Canada. It runs an online marketplace that connects student photographers with campus clubs and event organizers. These Terms of Service (“Terms”) are a binding agreement between you and GoCapturit governing your use of our website and services (the “Platform”). By creating an account or using the Platform, you agree to these Terms.
2. Eligibility & accounts
- You must be at least the age of majority in your province or territory to use the Platform.
- Accounts are for two roles: photographers (offering services) and organizers (booking services). You agree to provide accurate information and to keep your login credentials secure.
- You are responsible for all activity that happens under your account.
3. Bookings
Organizers post events and request a photographer; a photographer may accept or decline. A booking moves through the statuses pending → confirmed → completed (or cancelled). GoCapturit is a venue that facilitates these arrangements — the photography services themselves are provided by the photographer, not by GoCapturit. We are not a party to the agreement between an organizer and a photographer.
4. Payments, fees & escrow
- Payments are processed by Stripe. By paying or receiving funds you also agree to Stripe’s applicable terms. We do not store full card details.
- The photographer’s agreed rate is paid by the organizer. GoCapturit adds a service fee on top of that rate, charged to the organizer. The fee is a percentage of the rate and is shown before payment.
- Funds are held in escrow after payment and released to the photographer once the organizer approves the delivered gallery. Payouts to photographers are made through Stripe Connect and require a connected, verified payout account.
5. Refunds & disputes
Before funds are released from escrow, an organizer may request a refund, and either party may report an issue, which opens a dispute for our team to review. We may resolve a dispute by, among other things, issuing a refund of escrowed funds. Refunds are only available while funds are still held in escrow; once a payout has been released to the photographer, reversals are handled case-by-case and are not guaranteed. We are not obligated to mediate disagreements but may do so at our discretion.
6. Photo ownership & licensing
Unless the organizer and photographer agree otherwise in writing, copyright in delivered photographs remains with the photographer, who grants the organizer a license to use the photographs for the event’s intended purpose. You are responsible for any model, venue, or third-party permissions your event requires.
7. Acceptable use
You agree not to:
- break any law, infringe others’ rights, or post unlawful, harassing, or deceptive content;
- circumvent the Platform to avoid fees, or attempt to disrupt or probe our systems;
- misrepresent your identity, university affiliation, or qualifications.
8. Suspension & termination
We may suspend or terminate an account that violates these Terms or that we reasonably believe poses a risk to other users or to the Platform. A suspended account loses access to the Platform until the suspension is lifted. You may stop using the Platform and request account deletion at any time.
9. Disclaimers & limitation of liability
The Platform is provided “as is” without warranties of any kind. GoCapturit does not guarantee the quality, safety, or legality of any booking, photographer, or organizer. To the maximum extent permitted by law, GoCapturit is not liable for indirect or consequential damages, and our total liability arising from the Platform is limited to the service fees we collected on the booking giving rise to the claim.
10. Governing law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable there, without regard to conflict-of-laws rules.
11. Changes
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above; continued use after a change means you accept the revised Terms.
